Terms of service.
What you can expect from CarbRate, and what we expect from you. Written to be read rather than skipped.
1. The agreement
These terms are between you and Jeff Gaudette, operating CarbRate. By creating an account or using the CarbRate app or website you agree to them. If you don’t agree, don’t use the service. Questions go to [email protected].
You need to be at least 13 to use CarbRate.
2. What CarbRate is — and what it isn’t
CarbRate gives sports-nutrition guidance, not medical advice. It is not a medical device, it does not diagnose or treat anything, and it is no substitute for a doctor or a registered dietitian.
The app produces a fueling plan by applying published sports-science models to the numbers you give it. Those models describe populations; you are one person. Every figure it shows is a starting point to be tested in training, not a prescription to be followed blind on race day. That is why the app tells you to rehearse a plan before you race it.
Endurance exercise carries real risk, and so does changing what you eat and drink during it. If you have a medical condition, take medication, are pregnant, or have any history of gastrointestinal, cardiac, kidney or electrolyte problems, talk to a qualified professional before acting on anything CarbRate tells you. If something feels wrong during a run, stop.
We work hard on the accuracy of the underlying model and we document where each constant comes from. We still cannot promise a given plan will suit you, or that following it will produce any particular result.
3. Your account
You are responsible for what happens under your account and for keeping your password to yourself. Tell us promptly if you think someone else has got into it. Give us accurate information — the fueling maths is only as good as its inputs, and a wrong body weight produces a wrong plan.
You can delete your account at any time from the You tab in the app. We may suspend or close an account that abuses the service, breaks these terms, or puts other users at risk.
4. Subscriptions and payment
CarbRate is free to use with a genuinely useful free tier. Pro unlocks the full timeline, live race guidance, the complete course library and unlimited sweat tests.
- Where you buy. Pro subscriptions are purchased on carbrate.com through Stripe. The app itself sells nothing.
- Renewal. Subscriptions renew automatically at the end of each billing period at the then-current price, until you cancel.
- Cancelling. Cancel any time from your account, which opens the Stripe billing portal. Cancellation stops the next renewal; you keep Pro until the period you have paid for runs out.
- Deleting your account cancels immediately. If you delete your account while a subscription is active, that subscription is cancelled at once and the remainder of the period is not refunded. If you only want to stop paying, cancel instead of deleting.
- Refunds. If CarbRate isn’t working for you, email us within 30 days of a charge and we will refund it. Beyond that we handle refunds case by case, and we would rather sort it out than argue about it.
- Price changes. We will give you at least 30 days’ notice by email before a price change affects your renewal.
5. Your content and our content
Whatever you put into CarbRate stays yours. You grant us only the permission we need to run the service for you — to store your data, compute your plan and show it back to you. If you submit a product for the catalog, you also let us publish the verified product information, which is factual data about a commercial product rather than anything personal to you.
Everything else — the app, the site, the fueling engine, the Science Score methodology, the course content, the copy and the brand — belongs to us. You may use it for your own training and racing. You may not resell it, scrape it, republish the catalog, or use it to build a competing product.
6. Fair use
Please don’t:
- Break the law with it, or use it to harm anyone
- Scrape, bulk-download or systematically extract the catalog or course content
- Reverse-engineer the app or try to get at other users’ data
- Share an account across many people to avoid paying for it
- Submit deliberately false product information
7. Third-party products and links
CarbRate catalogs fuel products made by other companies and links out to where you can buy them. We verify nutrition data against the manufacturer’s own source and score it against published science, but formulations change and labels get updated — always check the actual label before you consume anything. We don’t make, sell or warrant those products, and we’re not responsible for them. Some outbound links are affiliate links; scores and rankings are never affected by that.
8. Availability
We aim to keep CarbRate running, but we don’t promise uninterrupted service. Features may change, and occasionally something gets removed. If we ever discontinue the service entirely, we will give you reasonable notice and a way to export your data.
9. Disclaimers and limits
To the fullest extent the law allows, CarbRate is provided “as is”, without warranties of any kind, and our total liability to you for any claim arising out of these terms or the service is limited to the greater of the amount you paid us in the twelve months before the claim, or fifty US dollars. We are not liable for indirect, incidental or consequential losses.
Some jurisdictions don’t allow certain limitations, so parts of this section may not apply to you. Nothing here limits liability for fraud, or for death or personal injury caused by our negligence, where the law does not permit that limitation.
10. Changes to these terms
We may update these terms. If a change materially affects your rights we will email account holders and update the effective date above before it takes effect. Continuing to use CarbRate after that means you accept the new version.
11. Governing law
These terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules, and the state and federal courts located in California have exclusive jurisdiction over any dispute. If any provision is found unenforceable, the rest stays in force.
